Terms and Conditions

  • These Terms and Conditions form part of any agreement or contract entered into for the supply of any goods or services by Universal Restaurant Equipment to a customer.
  • Universal Restaurant Equipment may amend these Terms and Conditions at any time by upgrading them on our page. You must check these given terms every time you come to our web page.
  • By continuing to reach and use our website, you give your consent to be bound by the amended Terms and Conditions.
  • No alterations or cancellations of any Terms and Conditions will be accepted unless agreed to in writing by Universal Restaurant Equipment.

Delivery

  • Universal Restaurant Equipment Pty Ltd uses third-party couriers for its delivery services. Delivery times and dates quoted are estimates only; standard delivery times are from 9:00 am to 5:00 pm, Monday to Friday.
  • Universal Restaurant Equipment Pty Ltd will not be held responsible for any loss incurred by a customer due to a delay in delivery of equipment where the delay has been caused by a third party or a result of bad weather or any other causes beyond the control of Universal Restaurant Equipment.
  • Universal Restaurant Equipment Pty Ltd shall incur no liability if the delivery of a product is hindered by any matter whatsoever beyond Universal Restaurant Equipment’s control and, in particular, without prejudice to the generality of the preceding, by an act of fire, flood, subsidence, sabotage, accident, strike, or lockout and Universal Restaurant Equipment shall not be responsible for any loss or damage from that place suffered by the customer.
  • Users must confirm that the delivery facility is always available at a user’s place. Suppose access is not available at an agreed time of delivery. In that case, the courier may have to come later, leading to an extra delivery charge. Otherwise, the delivery may be cancelled at the discretion of Universal Restaurant Equipment. We will still need invoice payment.
  • We will deliver the items to the kerbside, loading area or ground floor unless otherwise mentioned.
  • No allocation has been created for the installation, drop-off positioning, unpacking, connection or taking out of crates or packing material. We can deliver this service by taking a small amount. You can also get site-to-site assistance by asking.
  • Insurance or delivery charges are NOT included in the prices.
  • Delivery cost is subject to change without prior intimation.

Insurance

  • Universal Restaurant Equipment Pty Ltd shall not be responsible for the loss or damage to any items once delivered to the customer. Customer agrees to indemnify, defend and hold Universal Restaurant Equipment Pty Ltd and its affiliates and their respective employees, representatives, agents and independent contractors harmless from any claims, injuries, losses or damages (including personal injury, wrongful death, and attorney’s fees) arising from or related to the damage or loss of a product unless such loss or damage was caused solely by the gross negligence or wilful misconduct of Universal Restaurant Equipment.
  • The risk and title of products pass to the customer when the products are dispatched from the suppliers. The user assumes all danger and liability for damage, injury or loss to individuals and property of the products or their use and possession.
  • It is the responsibility of the customer to request insurance if required.

Claims

  • You must make a claim for damaged products within 48 hours of receiving the delivery of the products ordered.
  • You must send proof of damage with coincident images and details of the loss. Kindly send all the proof to cherry@universalrestaurantequipment.co.nz within 48 hours of getting the delivery of the ordered items.
  • The manufacturer will have the sole discretion of either repairing or replacing the damaged products.

Returns/Refund

  • In case of a customer has changed their mind, found an alternative product or due to a delay in delivery, Universal Restaurant Equipment will only accept returns or offer refunds within 15 days of purchase.
  • Applicable freight fees and a 30% re-stocking fee will be deducted from your refund credit. One can also apply to orders cancelled while in transit.
  • Products might be returned if they are not of agreeable quality, not adequate for purpose or have suffered a significant failure. However, refunds will subject to the return policies of the manufacturers.
  • If a product has been approved for return to the manufacturer, any costs involved in returning the product will be payable by the customer and not Universal Restaurant Equipment Pty Ltd.
  • We will only issue refunds in exceptional circumstances. These refunds will subject to the manufacturers’ terms and conditions.
  • Except to the extent otherwise needed by law (including, without limitation, the New Zealand Consumer Law), Universal Restaurant Equipment Pty Ltd will not be responsible to you, or any other individual, for any damage, loss, expenditure or cost incurred due to a direct or indirect delay in you getting any refund due to you, whether in negligence, contract or any other tort, equity, repayment, strict accountability, under law or otherwise at all.
  • All orders are final, and no refunds or returns will be unless one of the above exceptions applies.

Deposit and Payment

  • In consideration of Universal Restaurant Equipment Pty Ltd supplying the goods and equipment, the customer agrees it shall pay a deposit of at least 20% to secure the order.
  • The user has to pay the balance payment in full and then get delivery of the products. Failure to pay the balance within the agreed time frame will result in the cancellation of the order, and the customer will forfeit the deposit (unless a prior arrangement has been agreed upon between Universal Restaurant Equipment Pty Ltd and the customer).
  • Universal Restaurant Equipment Pty Ltd will dispatch the products once the purchase price balance is paid in full and the funds have cleared.

Goods and Services Tax

  • All prices advertised on the website are exclusive of GST unless otherwise stated.
  • You must pay GST on all goods and services quoted on the website and will be included in the invoice.

Prices

  • The cost of items, delivery, and other charges displayed on the website are current at the time of display. The prices can change without prior information.
  • Universal Restaurant Equipment Pty Ltd will not be liable for any price change not advertised on the website. Universal Restaurant Equipment Pty Ltd will always attempt to be as precise as possible with its product descriptions and pricing.
  • All images and photos on the website are only for display; some models and items may vary.
  • A pro-forma invoice will be dispatched to the user displaying all charges before payment is required. The total cost of the online orders will be displayed before payment is required via secure check-out.

Warranty

  • The manufacturer’s warranty covers all products sold on the Universal Restaurant Equipmentwebsite. Any warranties are given to offer you benefits apart from the New Zealand Consumer Law rights and solutions.
  • When offered, the warranty duration, provisions, and the individual offering the warranty connecting to your purchase differ as per the product you have bought.
  • Please refer to the manufacturer’s terms and conditions to know about the warranty term and conditions for your purchase.
  • Universal Restaurant Equipment Pty Ltd is a third-party seller and is not responsible for repairing or replacing faulty equipment. The manufacturers/wholesaler are solely responsible for repairing or replacing their equipment under their warranty terms.
  • Universal Restaurant Equipment is not liable for any damage/losses to the customer’s establishment and business due to products bought from Universal Restaurant Equipment Pty Ltd. The customer can direct all their concerns to the relevant manufacturer.
  • We will help direct our customers to lodge any service calls with the suppliers of the goods. Please refer to the manufacturer’s warranty conditions or visit the manufacturer’s website before purchasing for further information.
